Terms of Service

1. Acceptance of Terms

By creating an account or using ContentOps in any way, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

ContentOps is a software-as-a-service (SaaS) platform that provides AI-powered social media content generation, carousel creation, multi-client content management, and publishing automation tools for social media managers, agencies, and individual creators.

3. Account Registration and Security

• You must provide accurate, complete, and current registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized access at hello@contentopspmp.com
• One account per person or organization; account sharing is not permitted

4. Subscriptions and Billing

Plans and Fees

ContentOps offers paid subscription plans. Current pricing is available at contentopspmp.com/#pricing. All fees are in US dollars and exclusive of applicable taxes.

Free Trial

ContentOps offers a 14-day free trial with full access to platform features. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account will be downgraded and access to paid features will be disabled.

Billing

• Subscriptions are billed monthly in advance on the date you subscribe after your free trial
• You authorize us to charge your payment method on a recurring basis
• All subscription fees are non-refundable except as required by applicable law

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You retain access to the Service until the end of the paid period. We do not provide prorated refunds for partial months or unused time.

No Refund Policy

All payments are final and non-refundable. We do not offer refunds for any reason including but not limited to: dissatisfaction with the Service, unused features, or accidental purchases. By subscribing you acknowledge and agree to this no-refund policy. If you have billing concerns, contact us at hello@contentopspmp.com and we will work to resolve them.

5. Acceptable Use

You agree not to use ContentOps to:

• Violate any applicable laws, regulations, or third-party rights
• Generate content that is defamatory, obscene, fraudulent, or harassing
• Infringe on intellectual property rights of others
• Distribute spam, malware, or malicious content
• Attempt to reverse engineer, hack, or compromise the platform
• Use the Service for any purpose that violates the terms of connected social media platforms (Instagram, LinkedIn, Twitter/X, Threads, Pinterest)
• Resell access to the platform without written authorization
• Create multiple accounts to circumvent plan limits

We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. Content and Intellectual Property

Your Content

You retain ownership of all content you create, upload, or generate through ContentOps ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely to provide the Service to you.

AI-Generated Content

Content generated by our AI tools using your brand profile and inputs is provided to you for your use. We do not claim ownership of AI-generated content produced on your behalf. You are responsible for reviewing AI-generated content before publication and ensuring it complies with applicable laws and platform policies.

Our Platform

ContentOps, including its software, design, trademarks, and documentation, is owned by Kingstad Companies and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Third-Party Services and Integrations

ContentOps integrates with third-party platforms (social media networks, AI providers, analytics services). Your use of those platforms is governed by their respective terms of service. We are not responsible for changes to third-party APIs, platform policies, or the availability of third-party services.

You agree to indemnify, defend, and hold harmless Kingstad Companies and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or at our sole discretion with reasonable notice. Upon termination, your right to use the Service ceases. We will provide a 30-day window to export your data following termination except in cases of fraud or abuse.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these Terms shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction in Maricopa County, Arizona.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email and by posting the updated Terms with a new effective date. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
